Resumen
El objetivo principal de este artículo de revisión es establecer los límites al poder de reforma constitucional que una Asamblea Constituyente en Colombia debe respetar para reformar la Constitución Política colombiana. Para ello, se adopta un enfoque cualitativo y un análisis jurisprudencial, utilizando una metodología comparativa que permitirá identificar las coincidencias y discrepancias entre la Corte Suprema de Justicia y el desarrollo jurisprudencial de la Corte Constitucional respecto a los límites al poder de reforma constitucional del poder constituyente original. Al ejercer el poder de reforma constitucional, incluso por parte de una Asamblea Constituyente, es esencial respetar los límites materiales y formales establecidos por la Constitución. Esto implica honrar los principios esenciales del orden constitucional, tales como el Estado de Derecho Social, la dignidad humana, los derechos fundamentales y la separación de poderes, así como la idea de democracia como límite al poder. Además, es crucial seguir estrictamente los procedimientos legales para la convocatoria y el funcionamiento de la Asamblea. Estos límites garantizan que la reforma no se convierta en una violación ilegítima del orden constitucional y que el ejercicio del poder constituyente se mantenga alineado con los valores y principios democráticos que sustentan el Estado de Derecho en Colombia. El estudio comienza analizando los acontecimientos sociales y políticos que precedieron a la Asamblea Nacional Constituyente de 1991 para comprender la postura de la Corte Suprema de Justicia en la Sentencia 138 de 1990. Posteriormente, examina nueve fallos de la Corte Constitucional emitidos entre 1992 y 2016, en los que se delimitó la facultad de la Asamblea Constituyente para reformar la Constitución. Este análisis permitirá identificar el desarrollo jurisprudencial que la Corte Constitucional ha aportado a la tesis de los límites de la reforma constitucional a través del artículo 376 de la Constitución Política de 1991.
Abstract
The main objective of this review article is to establish the limits to the power of constitutional reform that a Constituent Assembly in Colombia must respect in order to reform the Colombian Political Constitution. To this end, a qualitative approach and jurisprudential analysis are adopted, using a comparative methodology that will serve to identify the agreements and disagreements between the Supreme Court of Justice and the jurisprudential development of the Constitutional Court regarding the limits to the power of constitutional reform of the original constituent power. When exercising the power of constitutional reform, even by a Constituent Assembly, it is essential to respect the material and formal limits established by the Constitution. This implies honoring the essential principles of the constitutional order, such as the Social Rule of Law, human dignity, fundamental rights, and the separation of powers, and the idea of democracy as a limit to power. Furthermore, it is crucial to strictly follow legal procedures for convening and acting as an Assembly. These limits ensure that the reform does not become an illegitimate breach of the constitutional order and that the exercise of constituent power remains aligned with the democratic values and principles that underpin the Rule of Law in Colombia. The study begins by tracing the social and political events preceding the 1991 National Constituent Assembly to understand the position of the Supreme Court of Justice in Judgment 138 of 1990. It then examines nine Constitutional Court rulings issued between 1992 and 2016, in which the power of the Constituent Assembly to reform the Constitution was delimited. This analysis will identify the jurisprudential development that the Constitutional Court has given to the thesis of the limits of constitutional reform through Article 376 of the 1991 Political Constitution.
