Resumen

Aunque la realidad de los Estados alrededor del mundo ha sido albergar diferentes culturas dentro de sus territorios, la estrategia para la construcción y la consolidación de las Naciones ha partido por la homogenización de la población. Los Estados democráticos liberales bajo la idea de igualdad ante la ley, observaban la diversidad cultural como problemática, pero que podía solucionarse a partir de estrategias de asimilación a la cultura mayoritaria. Este fue el tratamiento de la diversidad cultural en el Siglo XIX y solo empezó a cuestionarse en las últimas décadas del Siglo XX. Colombia con la promulgación de la Constitución Política de 1991, reconoce la multiplicidad de culturas existentes y consagra el derecho que tienen los pueblos indígenas de asumir el control de sus propias instituciones y formas de vida, brindándoles autonomía en sus territorios ancestrales y estableciendo la jurisdicción especial, esto con el fin de fortalecer la identidad de estos pueblos y asegurar su supervivencia. Debido a la novedad que significaba establecer este tipo de derechos, y a la falta de una reglamentación por parte del Congreso que coordinara las relaciones entre jurisdicciones, fue la Corte Constitucional la llamada a dirimir las controversias existentes entre formas de vida con lenguajes, pensamiento y formas de percibir el mundo diametralmente opuestas. Mucho se ha hablado de la importancia de los pronunciamientos de la Corte Constitucional - especialmente de la denominada primera Corte- para la protección de la diversidad cultural.

Abstract

Although the reality of states around the world has been to harbor different cultures within their territories, the strategy for building and consolidating nations has been based on the homogenization of the population. Liberal democratic states, under the ideal of equality before the law, viewed cultural diversity as problematic, but one that could be resolved through strategies of assimilation into the majority culture. This was the treatment of cultural diversity in the 19th century and only began to be questioned in the last decades of the 20th century. With the promulgation of the 1991 Political Constitution, Colombia recognizes the multiplicity of existing cultures and enshrines the right of indigenous peoples to assume control of their own institutions and ways of life, granting them autonomy in their ancestral territories and establishing special jurisdiction, all with the aim of strengthening the identity of these peoples and ensuring their survival. Due to the novelty of establishing these rights, and the lack of regulations from Congress to coordinate relations between jurisdictions, the Constitutional Court was called upon to resolve the existing controversies between ways of life with diametrically opposed languages, ways of thinking, and worldviews. Much has been said about the importance of the Constitutional Court's rulings—especially those of the so-called first Court—for the protection of cultural diversity.
