The Article addresses the issue of victims of kidnapping in Colombia and developing
jurisprudence of the Constitutional Court, which under the principle of solidarity,
eventually constitute a criminal policy that transformed the civil obligations assumed by
those before the kidnapping. In that sense, the issue of autonomy in contractual topics,
the limits on that freedom and the consequences resulting therefrom under the concept
of Estado social de derecho is developed.
