Resumen

La responsabilidad en el ámbito de la medicina obstétrica, especialmente en la atención de embarazos y partos de alto riesgo, plantea retos sustanciales dentro del sistema jurídico; a medida que la medicina avanza con nuevos conocimientos y procedimientos, las expectativas sobre el cuidado y el estándar de atención médica también se amplía, lo que genera la necesidad de una evolución constante en la doctrina y la jurisprudencia en materia de responsabilidad civil y patrimonial del Estado. En razón de la protección constitucional que se les ha dado a la madre gestante y al nasciturus o recién nacido, cuando se hace referencia a la aplicación de la medicina en el campo de la obstetricia, es menester anotar que estos procedimientos no solo involucran un alto nivel de especialización y precisión técnica por parte de los profesionales de la salud, sino que también exigen claridad en los estándares de responsabilidad civil y patrimonial en caso de que se produzcan daños a la madre o al recién nacido. En este contexto, resulta indispensable contar con un marco jurídico que no solo delimita los deberes y obligaciones del personal médico y del sistema de salud, sino que también proporciona criterios precisos para definir la carga jurídica de los profesionales y del Estado.

Abstract

Liability in the field of obstetric medicine, especially in the care of high-risk pregnancies and deliveries, presents substantial challenges within the legal system. As medicine advances with new knowledge and procedures, expectations regarding care and the standard of medical attention also expand, generating the need for constant evolution in the doctrine and jurisprudence concerning the State's civil and patrimonial liability. Given the constitutional protection afforded to pregnant mothers and the unborn child, when referring to the application of medicine in the field of obstetrics, it is essential to note that these procedures not only involve a high level of specialization and technical precision on the part of healthcare professionals, but also demand clarity in the standards of civil and patrimonial liability in the event of harm to the mother or the newborn. In this context, it is essential to have a legal framework that not only defines the duties and obligations of medical personnel and the health system, but also provides precise criteria to define the legal burden of professionals and the State.
