Despite the confidence required by the free appointment and removal position, the discretion in the administrative acts that declare the non-subsistence does not imply absolute powers, but rather submits the administration to the service improvement, to the common interest, to the legal requirements of the registration in the curriculum vitae, to the jurisprudential parameters of registration of reasons and to the respect for the fundamental rights of the public servant. Methodologically, the elements that prove the deviation of power before an arbitrariness in the non-subsistence of this type of jobs, its main means of proof and justification of the repetition action will be explained.
