Abstract
Among the benefits of merchants, according to the Regulations of the Consulate of
Bilbao from 1737, were waits and acquittances. The fraudulent bankruptcies were
not included. The debtor could extrajudicially deal with creditors and then present
to the judge or ask the judge that he would meet the creditors and thus deal with
them. In both cases the majority decision could force the minority. This system
was discussed after the independence. The reason was to protect honest merchants
affected by war and other misfortunes, but also to avoid bad faith. The argentine
province of Salta (also Buenos Aires and Tucumán) was an example of this situation.
Description
Entre los beneficios para los comerciantes, según las Ordenanzas del Consulado
de Bilbao de 1737, estaban las esperas y las quitas, que no incluían a los fallidos
fraudulentos. El deudor podía tratar extrajudicialmente con los acreedores y después
presentarse al juez o pedirle al juez que reuniese a los acreedores y así tratar con ellos.
En ambos casos la decisión de la mayoría podría obligar a la minoría. Este sistema
fue discutido después de la independencia. El motivo fue proteger a los comerciantes
honrados perjudicados por la guerra y otras desgracias, pero también evitar la mala
fe. La provincia argentina de Salta (además de Buenos Aires y Tucumán) fue un
ejemplo de esa discusión.
