Resumen

Las pólizas de responsabilidad civil son seguros que buscan proteger los bienes del asegurado que causa daños a un tercero. Sin embargo, es importante abordar estas pólizas desde las modalidades ofrecidas en el mercado colombiano. Con la entrada en vigor de la Ley 389 de 1997, cuyo objetivo era solucionar la dificultad financiera que generaba para las aseguradoras la indemnización de reclamaciones de responsabilidad civil con consecuencias prolongadas (riesgo de cola larga), se permitió el uso de la cláusula de reclamaciones hechas como una nueva modalidad de cobertura en las pólizas de responsabilidad civil, dejando de lado el modelo tradicional de ocurrencia para este tipo de póliza. El contrato de seguro bajo la modalidad de reclamaciones hechas implica el requisito de un requisito adicional para la configuración de la reclamación, ya que no se trata solo de la ocurrencia del evento generador, sino de la reclamación misma realizada al asegurado o a la aseguradora. Es decir, que la reclamación no será como tal la ocurrencia del evento que genera el daño, sino la reclamación del tercero realizada al asegurado o a la compañía durante la vigencia del contrato o el plazo acordado en el mismo. Esto supone una carga adicional para el asegurado, ajena a su ámbito de competencia y que depende totalmente de la reclamación del tercero afectado. A partir de ahí, se definirá la configuración y cobertura de la reclamación. Esta particularidad, permitida por la ley y demostrada por la negativa de las aseguradoras a indemnizar este tipo de siniestros, evidencia un posible desequilibrio en las cargas para las partes contratantes. Por consiguiente, en este trabajo de grado se analizarán las distintas modalidades de la cláusula de reclamaciones en el contrato de seguro de responsabilidad civil, así como los requisitos exigidos por la aseguradora para establecer la cobertura de la reclamación y las particularidades que estas generan en su desarrollo, con el fin de determinar si dicha cláusula puede considerarse legalmente abusiva respecto a la situación en la que queda el asegurado.

Abstract

Civil liability policies are insurances that seek to protect the assets of the insured who causes damage to a third party. However, it is important to address these policies from the modalities offered in the Colombian market. With the entry into force of Law 389 of 1997, with the purpose of solving the financial difficulty that it brought for insurance companies in the compensation of civil liability claims with prolonged consequences (long tails risk), the use of the claims made clause is allowed as a new modality of coverage in civil liability policies, leaving aside the traditional occurrence model for this type of policy. The insurance contract under the claims made modality entails the requirement of an additional requisite for the configuration of the claim, since it is not only about the occurrence of the generating event but the claim itself made to the insured or insurer. That is to say, that the claim will not be as such the occurrence of the event generating the damage, but the third-party claim made to the insured or to the company during the term of the contract or the term agreed therein. This means an additional burden for the insured that is outside their sphere and that totally depends on the claim of the affected third party. From there, the configuration and coverage of the claim will be framed. This particularity allowed by law, and as demonstrated by the refusal of insurance companies to compensate this type of event, evidences a possible imbalance in the burdens for the contracting parties. Therefore, in this degree work, a review will be made of the different modalities of the claims made clause in the civil liability insurance contract, as well as the requirements demanded by the insurer in order to establish the coverage of the claim and the particularities that these produce in their development, this with the aim of determining if said clause can be legally considered abusive with respect to the position in which the insured is left.
