This paper affords a description of the arguments used by Colombian, Mexican and
Brazilian Supreme Courts against the recognition of the adoption right by same-sex
couples. Differences and similarities existing in the legal Acts analyzed-- family, children’s
rights, free development of personality right, and equality right concepts-- were compared.
An exercise of Act contextualization is performed, bestowing a brief description of the
viewpoints of concerning groups, such as LGBTI community, clergy, State and political
parties’ representatives. Reports from main media broadcast and online sources, as well
as points of view of matter expert professionals in selected countries were used of this
purpose.
