De la religión del juramento al juramento legal: conclusiones de un estudio sobre la evolución del juramento procesal en Colombia durante el siglo XIX

This paper brings out the findings of a noteworthy work that contributes with new perceptions in relation to the secularization process of the Colombian judicial oath along the nineteenth century. Based on primary and secondary sources, it examines the oath´s worth as a guarantor of truth within the cultural purpose´s framework of judicial process. It also reflects on the political and judicial evolution of oath in Modernity, and recalls its slow development from the religious practice of oath towards the secularized pledge, inside the Colombian´s judicial proceedings. In addition, it makes known the strong relationship between religion and the procedural oath; therefore contributing to the identification of the most important characteristic of the jurisprudence practices existing in the nineteenth-century.
La consolidación de la Constitución de 1853: debates y consensos

This paper explores and illustrates the multifaceted engagements and deliberations that took place within the political scenery of the Colombian Constitution of 1853, in order to identify the involved agreements which favored for its construction and consolidation. Primary and secondary sources are used, trying to demonstrate three central assumptions: (I) in the territorial order: the Constitution of 1853 represents the beginning of solidification of a federal system in Colombia, seeking to unify, to grant the independence, and to give a political strength to the provinces of the period, (ii) at the institutional level, it intended to consolidate the State paying special attention to the popular will, while limiting the authority to the president to assume other powers; and finally (iii) the Constitution provided guarantees of civil liberties, such as freedom of press, universal suffrage, and freedom of religion
La propiedad territorial indígena en la Provincia de Popayán (1831-1857): continuidad del proteccionismo, situación de excepción frente a lo dispuesto en otras provincias

Indigenous land property was a top importance issue in the early ages of the republican life of Latin American countries. Adaptation of the old regime´s legal system, to accomplish with the new conceptions of the State, had to weigh up the numerous political hitches at stake on the birth time of modern states. The Colombian´s legal process had different characteristics perceived from one region to another, for this kind of property. I also had a greater impact in places such as the Popayan province, where the indigenous population was at a high concentration. This article displays a sequence on the evolution of the legal and political management of the indigenous ownership in the province of Popayan between 1832 and 1857.
Inclusión de los estándares internacionales sobre los derechos de los pueblos indígenas en políticas bancarias y programas REDD+

This paper evaluates the inclusion of the rights for indigenous peoples within the standards of international law and policy, in accordance to the obligations established by the International Law of Human Rights. The analysis targets to assess the degree of implementation of international standards on the rights of indigenous peoples, in the development programs and projects, by the Governments, particularly Guatemala. First, it reflects the evolution of the international law in relation to the recognition of the rights of indigenous peoples; then analyzes the adjustment of the internal law of States, to meet the international and regional standards, in the framework of relative international human rights´ obligations. Finally, it addresses the importance that States have granted to the rights of indigenous peoples in development programs and projects
Impacto del activismo judicial sobre la garantía del derecho a la educación en Santiago de Cali

La Corte Constitucional a través de la sentencia T-025 de 2004, declaró el estado de cosas inconstitucional en el caso del desplazamiento forzado en Colombia. Este tipo de decisiones ha sido objeto de debate acerca de la función que les corresponde, o no, cumplir a los jueces dentro de la formulación y seguimiento de las políticas públicas que garantizan derechos económicos, sociales y culturales, como la educación. El denominado activismo judicial ha visibilizado la necesidad de replantear la noción clásica de la separación de poderes y las relaciones entre ramas del Poder Público. A partir de la revisión de la situación de acceso y de las condiciones de permanencia en el sistema educativo de 285 menores, vinculados a una organización de población desplazada, y con el propósito de aportar algunas conclusiones a la comprensión de las relaciones entre ramas, este artículo pretende mostrar cómo un gobierno local, en este caso el de Santiago de Cali, ha adoptado la jurisprudencia de la Corte Constitucional para elaborar una política pública educativa dirigida a menores en situación de desplazamiento forzado. Se pretende esclarecer los alcances del activismo judicial a nivel local y predecir posibles efectos del uso de los indicadores o de la regulación que, en el caso de desplazamiento, se genera a partir del fallo judicial.

From a gender perspective this article critically analyses the Colombian pension legislation system. Through the distributional analysis of rights methodology, the authors deliberate on the positive impact of women retirement plans from labour tasks. The results show that this benefit does not compensate the work developed, in a greater degree and extent by the female population; on the contrary, it discourages the women´s participation in the formal labor market.
Adopción por parejas homosexuales: de la realidad social hacia el reconocimiento judicial

This paper affords a description of the arguments used by Colombian, Mexican and Brazilian Supreme Courts against the recognition of the adoption right by same-sex couples. Differences and similarities existing in the legal Acts analyzed-- family, children’s rights, free development of personality right, and equality right concepts-- were compared. An exercise of Act contextualization is performed, bestowing a brief description of the viewpoints of concerning groups, such as LGBTI community, clergy, State and political parties’ representatives. Reports from main media broadcast and online sources, as well as points of view of matter expert professionals in selected countries were used of this purpose.
