This article reconstructs the judicial precedent of the Supreme Court of Colombia
regarding the constitutional control of laws elaborated with procedural deficiencies
in their creation. It begins with an analysis of the 1912 decision whereby
the Court declared its incompetence to judge the constitutionality of laws for
these reasons. Relevant sentences are included which support this precedent.
Later, the article concentrates on the precedent´s overrule in 1952 whereby
the Court modifies the 1912 doctrine and declares its competence to judge the
constitutionality of laws elaborated with procedural deficiencies.
