Further, it set a comparison of the experiences of France and Colombia from a perspective that put in discussion the agency of local management and free market around the provision of water and sewer service. To support this idea different aspects of the constitutional and legal system are reviewed as well as the role of competition in the provision discussion of household public services, insofar as it means a theoretical challenge to the Colombian legal system. Subsequently, it is come to explain the response to the countermajoritarian difficulty where judges are an auxiliary democracy through judicial review. Next, it will be shown the image of prestige of the courts and the educational function. This argument says that judges are not a countermajoritarian power, by contrast, are supporting democracy. Bogotá: Universidad Externado de Colombia, Serie de Teoría Jurídica y Filosofía del Derecho, N. 55.Ítem Indicadores Doing Business como tecnología de gobernanza global sobre la administración de justicia en Colombia(Universidad Icesi, Facultad de Derecho y Ciencias Sociales, 2014-07-01) Sánchez, RobinsonThe use of indicators such as global governance technology has enabled the incorporation and consolidation in the different states of the ideology and interests of public and private actors capable of exercising it. This is the case of the administration of justice in Colombia, where the World Bank Group, through its Doing Business indicators, has justified a discourse on the inefficiency of the judicial system and the need for reform. With this, the national government, while acting as a government and promulgator of these indicators proposed a constitutional reform that gave the judicial function to private individuals and officials, different judges, to resolve this cases. But the exercise of defense advanced by the Superior Council of the Judiciary and some social organizations actors in the administration of justice achieved an important citizen mobilization of indignation, forcing the file of reform. Today there are conditions for further discussion on the administration of justice that the country needs, but the strength of the World Bank Group as governor, avoids escape of his work for global governance; although makes possible the incorporation of new social and political agendas that diversify the discussion on the Colombian judicial system and allow for regulation in measurements of the same.Ítem Between Democratic Security and Democratic Legality. Constitutional Politics and Presidential Re-election in Colombia(Universidad Icesi, Facultad de Derecho y Ciencias Sociales, 2014-07-01) Boesten, JanThis paper presents an analysis of the political and legal debate of the declaration of unconstitutionality of the referendum that sought the re-election presidential second term in 2010. On the other hand, it exposes the debate between those who spoke of bias and political argument in the court ruling related to the idea of “democratic security”; while others speak of the persistence of “democratic legality” consisting of autonomy guaranteed legal reasoning from deliberative processes. Finally, it is noted that the degree of institutionalization of discourse of the Court is an important factor that speaks in favor of it’s independence.
