    De las aulas universitarias a la toga: la trayectoria académica de los ministros del Supremo Tribunal Federal brasileño (1988-2013)

    Through the study of the academic trajectories of the ministers of the Supreme Federal Court of Brazil and through the inclusion of the requirement of “notorious legal knowledge” imposed by the 1988 Constitution to all members of the court, this article intends to unveil patterns or criteria, which today are unclear, of what in practice has been considered an outstanding life trajectory of elected ministers, and its greater or lesser relation to the academic past of the magistrates. In this way, it is proposed to delve into the question of how the changes in the legal market of the last decades have impacted on the way in which the positions of magistrates have been provided in this court.

    Colombia’s Critical Juncture: The Communicative Origin of the 1991 Constitution

    It is said that the Constitutions of the nineteenth century Colombia were battle cards that appeased the military confrontation, but at the same time they contained the seed for the next confrontation. The 1991 Constitution breaks with that tradition, as it is not perceived as a battle card, but as a peace pact. Through a comparative politics methodology, this article contrasts the constitutional process of 1991 with other scenarios of deep institutional reconstruction to argue that what makes the 1991 Constitution different from those battle cards was the type of crisis that led to the constitution of the National Constituent Assembly, its origin in a popular movement committed to a communicative action and, lastly, its inclusive and deliberative character, in which groups traditionally marginalized were heard.

    Un derecho contractual para el derecho a la vivienda

    The conditions of contracts that allow access to housing are intrinsically related to the implementation of the right to housing. Based on this relationship between the right to a decent roof and the material circumstances of citizens expressed in contractual clauses, the Colombian Constitutional Court has built some rules that seek to protect the housing rights of housing consumers. In this context, this article analyzes the constitutional jurisprudence that has referred to housing contracts and presents the challenges that such decisions suggest to traditional institutions usually studied by private law.

    Constitución de 1991, Ley de Cuotas y movimiento feminista: el papel del derecho en la generación de estructuras de movilización

    This paper highlights how little conceptualization there is on the relationship between the use of legal mobilization and social movements’ mobilizing structures. To contribute to such theorization, it proposes a hypothesis of the impact of the 1991 Colombian Constitution on the feminist movement. Through the case study of the campaign around the Quota Act, it argues that the most important impact was the generation of meeting arenas for the emergence of new mobilizing structures.
