    La prohibición de reforma peyorativa como principio y garantia constitucional

    The non reformatio in peius is a constitutional principle and a procedural guarantee that limits the decision-making power of the superior judge, prohibiting aggravating the situation of the defendant who has appealed the sentence or part of it as sole appellant. The exception to the application of this principle is found in decisions that by law must be submitted for consultation. Around this principle, a broad jurisprudence of the Constitutional Court and the Supreme Court of Justice has been consolidated, which have defined its scope and application, contrasting the aforementioned principle with that of legality, the due process and the right of defense.

    Litigio estratégico comunitario: retos para su sostenibilidad en las Facultades de Derecho

    The work of law clinics is becoming more and more relevant in the Latin American context. In spite of this, the academic reflection does not manage to keep up with the advances shown in the Faculties of Law. This text describes a project of investigation and social-legal intervention carried out by our clinic in a community that faces serious problems of contamination of its streams. This experience is analyzed in its cultural context, from a critical perspective; emphasizing the challenges to the sustainability of this type of work.

    La protección judicial del individuo desde el postulado federal de los EE.UU

    Historically, individual rights protection on American constitutional grounds might be explained through economic reasons. Those reasons were a consequence of territorial expansion, coast-to-coast, during the XIX Century. Encouraging industrial production justified all kind of activities such as slavery, judicially enforced even by Supreme Court decisions. Tensions between Northerners and Southerners upon slavery matters ended up on Civil War. Recognition of state’s competencies being the core of the matter. It was until the next constitutional crisis, after President Roosevelt’s intervention on increasing federal regulation (during the 1929 economic depression) when federal competencies started to dominate over state’s rights. Federal protection of individual rights has functioned in a very stable manner until today. But probably, that scheme of protection would not be the same after 2017 presidential term.

    Análisis terapéutico de precedentes: un estudio de la intersexualidad a partir de los pronunciamientos de la Corte Constitucional

    A partir de la perspectiva que plantea la jurisprudencia terapéutica en el estudio de casos judiciales, fueron sometidos a revisión los nueve fallos que hasta ahora ha emitido el Alto Tribunal de la Jurisdicción Constitucional colombiano acerca del problema jurídico más importante relacionado con la intersexualidad, esto es, el de la obtención del consentimiento informado en los procedimientos de reasignación de sexo o normalización. La regla jurídica adoptada como precedente judicial genera eventuales efectos terapéuticos o anti-terapéuticos según la obtención del consentimiento informado privilegie el ejercicio de la autonomía del menor de edad intersex, o el de sus representantes legales

    ¿Cómo deciden las Cortes Constitucionales?

    The purpose of this article is to explore the mode of production of judicial sentences drafted by constitutional courts in Europe. The natural object of study of the constitutional theory is the analysis of this final product of judicial creation of Law by Constitutional Courts. However, the doctrine has not given sufficient attention –from a comparative law perspective– to the mechanisms and procedures that lead to the decisions of these institutions. Thus, this document will classify the different types of decision-making processes in the courts, analyzing the stages that make up the «mode of production», from the study of the decisions of the Supreme Court of the United States, the Constitutional Council of the French Republic, The Constitutional Court of Italy and the Federal Constitutional Court of Germany. At the end of the paper, some conclusions are made about the period of the magistrates, their party affiliation, the temporary restrictions of deliberation and institutional factors such as the number of attendees or the personalization of its members.
