La participación ciudadana como mecanismo de protección del medioambiente : el caso de la consulta previa en comunidades étnicas

El presente artículo aborda el tema de la consulta previa como mecanismo de participación democrática y derecho fundamental enfocado en la protección del medioambiente, las comunidades étnicas, su entorno sociocultural y la relación entre el territorio, la identidad y los recursos naturales. En ese sentido, se analizan las distintas interpretaciones que las altas cortes han hecho del mecanismo de participación ciudadana y sus implicaciones en la construcción y protección del ambiente como recurso indispensable para la supervivencia de los pueblos.

This article addresses the issue of prior consultation as a mechanism for democratic participation focused on the protection of the environment, ethnic communities, their socio-cultural environment and the relationship between territory, identity and natural resources. In this sense, we analyze the different interpretations that the high courts have made of the citizen participation mechanism and its implications in the construction and protection of the environment as an indispensable resource for the survival of the peoples.
