La legislación sobre licencias de maternidad y paternidad como factor de igualdad entre hombres y mujeres : el caso colombiano.

Este trabajo tiene como propósito analizar las iniciativas legislativas del Congreso de la República de Colombia en materia de igualdad de género; de manera específica, en lo referente al régimen de licencias de maternidad y paternidad y la forma como estas influyen en la consolidación de la igualdad entre hombres y mujeres. Las iniciativas legislativas serán agrupadas en tres modelos de licencias: 1. un modelo de distinción entre hombres y mujeres, asociado a un concepto de cuidado feminizado; 2. un modelo de igualdad a partir de la corresponsabilidad, y 3. un modelo intermedio donde prima la liberalidad de los progenitores.

This paper aims to analyze the legislative initiatives of the Congress of the Republic of Colombia in the area of gender equality; specifically, as regards the system of maternity and paternity leave and the way in which they influence the consolidation of equality between men and women. Legislative initiatives will be grouped into three models of licenses: 1. a model of distinction between men and women, associated with a concept of feminized care; 2. a model of equality based on co-responsibility, and 3. an intermediate model where the liberality of the parents prevails.
