Ítem Superando la crisis financiera global: una visión general de la experiencia canadiense(Universidad Icesi, 2012-07-01) Torrie, VirginiaLos signos iniciales de un hundimiento del mercado estadounidense de hipotecas de alto riesgo han demostrado ser más que la punta del iceberg de dudosas prácticas y productos financieros que conducen a la actual crisis económica. En estos momentos de gran investigación y reforma financiera, vale la pena examinar el impacto de la crisis financiera en la economía canadiense, ya que esta ha sido marcadamente diferente a la experiencia americana. Es de destacar el hecho de que los sistemas financieros canadienses parecen haber estado muy aislados de gran parte de la tormenta financiera. Este artículo argumenta que la resistencia de Canadá es atribuible en gran parte a un entorno regulatorio más conservador, que redujo gran parte de la conducta problemática que ha llevado al mundo al borde de la crisis financiera. Sin ser un estudio exhaustivo, este trabajo ofrece una visión general de los impactos de la crisis económica en Canadá y pone de relieve los factores claves que han contribuido a la experiencia canadiense.Ítem El Estado hobbesiano: una mirada desde la filosofía de Judith Butler(Universidad Icesi, 2012-07-01) Castelar Caicedo, Andrés FelipeThis paper reviews the founding process of the State proposed by Hobbes, according to which it was necessary for men to establish an initial contract between them in order to transfer justice administration to a third party. The review rises from the theoretical terms proposed by the American philosopher Judith Butler, who believes that the naturalization of the State, as a regulatory body of social relations, is assimilated under the “iterative citation” of performative acts, i.e. the ritualized act repetition, gestures and speeches that naturalize these conventions and fade out affectations. The State, represented as the sovereign who exercises control and maintain domination using rules and power, is established on the naturalized acts of a hypothetical introductory momentum that turns fear into peace, discordance in agreement, and conflict into stillness. Such a momentum of mythical character would precisely be the one which would place the fundamentals of modern political practice, as it accepts, as a normal act, that fright and disbelief are the forces which drive human society.Ítem Sobre la complejidad de la decisión judicial(Universidad Icesi, 2012-07-01) Taruffo, MicheleThis article aims to explain the complexity and the crucial role of judicial decision and argues that the purpose of the judicial decision consists of settling a controversy according to legal and controllable rational criteria. To achieve the proposed goal, the author refers to the (i) Dialectical, (ii) Epistemological, (iii) Juridical, (iv) Logical, (v) Axiological, and (vi) common sense dimensions, as explanatory categories of judicial reasoning. It is concluded that the construction process of the argumentative reasoning of the judge, at the time of motivating its decision, is complex because it does not depend on a single system or dimension, but on the contrary, it is based on diverse disciplines, on logical and cognitive structures, and even on experience as a justifying premise.Ítem El Código Civil en México: entre la forma y la tradición(Universidad Icesi, 2012-07-01) Narvaez H., José RamónThis article examines, through examples, the various ways in which the theoretical and normative sources that converged in the historical process of codification in Mexico, were transplanted and received. In addition, it argues that the peculiarities of Mexican pluralism turned the compiling and codifying tasks of the European absolutist completeness (completezza) project especially difficult; due to the complexity of the social and historical dynamics of the Mexican context, its open and less formalist culture, the entry of the Napoleonic, German, Portuguese, and Chilean codes were nuanced and adapted in a unique way, as well as specific concepts such as person, civil registry, secular marriage, legal business, possession, etc., by reason that, in many respects, they went against the practices of population.Ítem A propósito del Código y la codificación(Universidad Icesi, 2012-07-01) García Ramírez, JuliánThis article aims at proposing a different reading of the codification, decodification and re-codification processes as individual and complex processes. To that end, the ideas underlying the idea of code as an illustrated, nineteenth-century, and contemporary proposal are made explicit and analyzed, and the concept of code is reconstructed in the present.Ítem El Orden Social en la Regeneración(Universidad Icesi, 2012-07-01) Henao Albarracín, Ana MaríaThe troublesome nature of order --assumed as the distinction between legitimacy and illicit, conventional and unusual, recognized and inconsistent-- enforced with determination in the Colombian political life of the nineteenth century, and came to be a major concern around which moved many of the political deliberations of the epoch. This article illustrates some of the major topics relative to the social order difficulties arisen during the political process led by the conservative elite in the late nineteenth century, the so-called “Regeneration”. These arguments will be explained in specific regulatory principles, which configure the individual rights and freedoms essential to establish the public order. Noticeable in the drafting of the Constitution of 1886 and in the following articles, they will change in terms of their original text, in account of a more authoritarian and centralist tendency, detected within a nation-building project, aimed to the homogenization, cohesion and national coexistence. Therefore, it would turn out to be the hope to resolve the complications of order and frustrated peace.Ítem La justicia administrativa entre dictaduras: una crítica a la construcción del derecho administrativo en Colombia(Universidad Icesi, 2012-07-01) Sarmiento Erazo, Juan PabloThe Colombian institutional experimentalism and the dictatorial governments of elected presidents Mariano Ospina Pérez (1946 to 1950) and Laureano Gómez Castro (1950 to 1952), and the military regime of Gustavo Rojas Pinilla following the coup (1953 to 1957), led to a more pronounced concentration of the national executive branch since the beginning of the 20th century in Colombia, due to the authoritarianism with which they ruled. From this perspective, there is a quite rich context of jurisprudential production, where the political and institutional capacity of the Council of State would be tested. It is argued that the mediation capacity of the Council would be committed to an exercise of dictatorial power as the Colombian Council of State was instituted as the judicial organ in the centralizing project of the “Regeneración”, but that was converted, during the “Republican” governments subsequent to the dictatorship of Rafael Reyes in 1910, in the institution in charge of controlling the legality of acts of the public administration.Ítem La generación del Estado de sitio: el juicio a la anormalidad institucional colombiana en la Asamblea Nacional Constituyente de 1991(Universidad Icesi, 2012-07-01) Barreto Rozo, AntonioFrom the narratives and evaluations forged by the Supreme Court of Justice and the National Constituent Assembly of 1991, this text aims to demonstrate that during the 20th century, Colombia was ruled by norms of public order that strongly restricted liberties and disarticulated the normal functioning of the public authorities. To achieve this objective, the author goes over history to clarify three points: the ways in which the executive power was consolidated in regards with public order issues, tensions and ruptures that occurred during the state of emergency of 1984, and strong criticisms that the caucus goers of the National Constituent Assembly of 1991 made regarding the state of emergency figure contained in the Constitution of 1886.
