Reglas de origen en la Alianza del Pacífico

Abstract

El objetivo de este trabajo es comparar las reglas de origen entre el acuerdo de integración regional Alianza del Pacífico y los tratados de libre comercio de Colombia con Chile, la CAN y el G3, con el propósito de determinar si existen diferencias significativas entre estos. En el transcurso de la investigación, se encontró que sí existen diferencias en las reglas de origen entre estos acuerdos comerciales, que pueden generar incentivos al exportador para elegir un acuerdo en específico. La principal conclusión, es que no siempre la mejor opción para exportar a Chile, México o Perú es a través de la Alianza del Pacífico, como se esperaría siendo este el acuerdo pactado más reciente. La elección del acuerdo depende de la mercancía a exportar, por lo cual se recomienda buscar antes la subpartida arancelaria y analizar por cuál tratado sería más beneficioso hacerlo, de acuerdo a sus características y composición. The objective of these paper is to compare the rules of origin of the regional integration agreement Pacific Alliance, and the preferential agreements between Colombia and Chile, the Andean Community and the G3, aiming to find if there are meaningful differences between them. During the research, it was found that there are differences in the rules of origin of these preferential agreements that might generate incentives for exporters to choose a specific agreement. The main conclusion is that not always the best option to export to Chile, Mexico or Peru is through the Pacific Alliance, as expected for being the most recent agreement. Therefore the choice of the trade agreement depends on the merchandise that is goin g to be exported, for it is advisable to look for the trade tariff commodity code for the specific product and analyze from which agreement it would be more beneficial, given its characteristics and composition
